Since 1 April 2013, companies have been able to elect for the beneficial ten per cent corporate tax rate on profits derived from patents registered in the UK and elsewhere in the EU.

Provided the company can qualify under the development condition, then a percentage of their profits directly derived from their patents can be taxed at ten per cent.

We work with management to identify the income derived from patents, formulate the calculations to justify the claim to reduce the tax rate on the identified income and support them through the compliance process.

This is particularly useful in conjunction with R&D tax credits for new start-up technology and spin-off companies in enhancing the return to shareholders, especially in the early years of trading.
